Every case in the country, no matter how complex or serious, starts in a Magistrates’ Court.

Since October 2006, Her Majesty’s Government, with a view to excluding vast number of society, has made Legal Representation means tested.

This means if, in general terms, you earn more than £20,740.00 (gross), then you have to pay for your own defence.

Even if you are financial eligible you must still convince the Court that you qualify under the interests of justice test whereby your case is so grave or complex that you require the services of a solicitor.

If you are in receipt of the standard benefits then you will not have to pass the financial hurdle, but you will still be subject to the interests of justice test before you are entitled to a solicitor.
